NFC Rental Management System — Terms and Conditions
Version 1.0 · Effective from publication
This is a draft operating agreement for the NFC Rental Management System. NFC should confirm its legal business name, contact details, prices, service commitments and dispute process before commercial launch.
1. About the service
NFC Rental provides software tools to help landlords, property agents and authorised staff manage properties, units, tenants, leases, rent records, payments, expenses, maintenance and reports. Features may change as the service is maintained or improved.
2. Account security
Each user must keep their login credentials confidential, use an appropriate password, sign out of shared devices and promptly report suspected unauthorised access. Users must not share accounts or attempt to bypass role-based permissions.
3. Customer responsibilities and tenant data
Landlords and agents are responsible for ensuring they have a lawful basis and any required permissions or notices before entering personal information about tenants, guarantors, staff or other people. They must enter accurate information, restrict access to authorised users, and use the system only for lawful rental-management purposes.
4. Acceptable use
Users must not misuse the service, access data without authority, interfere with the system, upload unlawful content, or use the system to harass or unlawfully discriminate against others. NFC may investigate credible reports and restrict access where reasonably necessary to protect users, data or service integrity.
5. Records and decisions
The system supports record-keeping but does not guarantee that user-entered information is accurate or that a rent, lease, legal or financial decision is correct. Users should check entries, retain appropriate records and independently verify important transactions.
6. Availability, backups and maintenance
NFC will make reasonable efforts to maintain the service, but uninterrupted availability cannot be guaranteed. Maintenance, hosting issues, network failures or events outside NFC's reasonable control may affect access. Customers should maintain appropriate records and backups for their own business needs.
7. Fees and suspension
Any subscription price, billing period, trial, renewal, suspension or cancellation terms should be stated in the applicable plan or customer agreement. Access may be restricted for security, serious misuse, overdue fees where applicable, or legal requirements, subject to applicable law and any agreed notice process.
8. Privacy and third-party providers
Use of the service is also subject to the Privacy Notice. Hosting, backup, communications or other providers may process information when needed to operate enabled features, subject to appropriate safeguards and applicable law. Optional third-party communications require a separate choice where applicable.
9. Intellectual property
The software, interface, branding and related materials are owned by NFC or its licensors. Customers receive permission to use the service for their authorised rental-management activities; this does not transfer ownership of the software.
10. Liability and applicable law
To the extent permitted by law, NFC is not responsible for losses caused by inaccurate user entries, unauthorised credential sharing, third-party network failures or decisions made without independently checking records. Nothing in these terms excludes liability that cannot legally be excluded. These terms are intended to operate subject to the laws of Kenya.
11. Changes and contact
NFC may revise these terms as the service changes. Material revisions should be presented to users for renewed acceptance. For support, privacy questions or complaints, contact the NFC System Administrator using the contact details provided to your account. NFC should publish a verified business email and phone number here before launch.
